Litigation

James Tuite and Joanne Scott and our team have extensive experience in litigation.

We are able to assist individuals and corporations in defending and pursuing claims in all NSW courts and jurisdictions as well as the High Court of Australia.

We also understand that litigation is risky and the costs involved can be excessive. We are committed to negotiating matters in an attempt to assist our clients with mediations and alternative dispute resolutions to avoid lengthy and costly court proceedings.

Our litigation services include:

  • Insurance claims (see Insurance Law for more information);
  • Commercial litigation including:
    • breach of contract;
    • intellectual property;
    • mortgage and guarantee disputes; and
    • trade practices.
  • Debt recovery;
  • Negligence claims (professional and personal);
  • Property disputes; and
  • Disputed wills and estates.

James has also been involved in a number of large scale enquiries and Commissions and represented both plaintiffs and defendants in large commercial matters in the Federal Court of Australia, Supreme Court of Australia, and the High Court of Australia. We have also been involved in the following government enquiries:

  • Police Integrity Commission;
  • HIH Royal Commission;
  • The NSW Special Commission of Inquiry into the Waterfall Train Accident; and
  • The Phuong Ngo Enquiry.
